circumstances as his left hand had been seriously wounded by

the explosion of a gun barrel, and he had to undergo an opera-

tion after he reached England. There was, therefore, no

"oversight" in granting him leave, as the Chief Justice

contends in paragraph 5 of his letter of the 1st October. It

would not therefore have been unreasonable to require the

Chief Justice to postpone his leave although I admit that post-

ponement would have caused him very serious inconvenience. In all

the circumstances of the case I am prepared to recommend that

the amount of £47.12.6 in question should not be recovered from

Sir F.T.Piggott but should be paid by the Colony, and I shall be

glad to have Your Lordship's instructions in the matter.
